Terms of Use

1. About Evaxify

Evaxify ("the App") is a mobile application that helps you track vaccination schedules for yourself, your family members, and pets. It is developed and operated by Aliaksei Misuna, an individual developer ("we", "us", "our").

These Terms of Use ("Terms") govern your access to and use of the Evaxify mobile application and the website evaxify.com.

2. Medical Disclaimer

The App does not verify the accuracy or completeness of vaccination records you enter. You are solely responsible for the accuracy of the data you input.

3. Eligibility

• You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an Evaxify account and act as the account holder for your family's profiles.
• By using the App, you confirm that you have the legal capacity to enter into this agreement.
• You may create profiles for children or other family members in your care, provided you are their parent or legal guardian or have their explicit authorisation.

4. Your Account

• You may sign in using an email address and password, your Apple ID, or your Google account. You are responsible for maintaining the security of your credentials.
• You agree to provide accurate information when setting up profiles.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at a.misuna@yahoo.com if you suspect unauthorised access to your account.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to access, modify, or interfere with other users' data.
• Reverse-engineer, decompile, or disassemble any part of the App.
• Upload content that is false, misleading, harmful, defamatory, or that infringes any third party's rights.
• Use automated scripts, bots, or scrapers to interact with the App.
• Upload documents that do not belong to you or that you are not authorised to process.

6. Your Data and Content

You retain ownership of all vaccination records, profile information, and documents you enter into the App. By uploading content, you grant us a limited, non-exclusive licence to store and process it solely for the purpose of providing the App's features to you.

7. AI-Assisted Document Scanning

The App offers an optional feature that uses artificial intelligence to extract vaccination records from photos of vaccination cards.

• AI extraction is not guaranteed to be accurate. You must always review and verify any extracted data before saving it.
• By using this feature, you agree to your document photo being sent to Anthropic Claude via AWS Bedrock (EU) for processing. See our Privacy Policy for details.
• We are not responsible for errors in AI-extracted data. Final responsibility for the accuracy of your vaccination records rests with you.

8. Intellectual Property

All content, design, code, and trademarks in the App (excluding your own data) are owned by or licensed to Aliaksei Misuna. Nothing in these Terms grants you any right to use the Evaxify name, logo, or other intellectual property without prior written permission.

9. Availability and Changes

• We aim to keep the App available continuously, but we do not guarantee uptime. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• We reserve the right to modify, suspend, or discontinue any feature of the App at any time, with reasonable notice where possible.
• We may update these Terms from time to time. We will notify you of material changes via in-app notification or email at least 14 days before the changes take effect. Continued use of the App after that date constitutes acceptance of the updated Terms.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Evaxify and Aliaksei Misuna shall not be liable for:

• Any inaccuracy in vaccination schedule data displayed in the App.
• Any health outcome resulting from reliance on information in the App.
• Loss of data due to technical failure, although we take reasonable steps to prevent this.
• Any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded under applicable law (including EU consumer protection law).

11. Termination

You may stop using the App and delete your account at any time via the Settings screen. Upon deletion, your personal data will be permanently erased within 30 days.

We reserve the right to suspend or terminate your account if you violate these Terms, with notice where reasonably practicable.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Poland, without regard to its conflict-of-law provisions. If you are a consumer residing in the EU, you also benefit from any mandatory protections provided by the law of your country of residence.

For EU consumers: the European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obligated to participate in alternative dispute resolution, but we will always try to resolve disputes amicably — please contact us first at a.misuna@yahoo.com.

13. Subscriptions (Evaxify Plus)

Evaxify is free to use. Core vaccination tracking — the smart calendar, reminders, the family timeline and up to two profiles, plus attaching a photo to any vaccination you record — is available without any payment. Evaxify Plus is an optional auto-renewing subscription that unlocks:

• Unlimited profiles — add every family member and pet (the free plan is limited to two profiles).
• Scan — start from a photo of a vaccination card and create several records from a single picture.
• PDF export — export one profile's or the whole family's vaccination schedule as a PDF.

Plans, length and price. Evaxify Plus is offered as a 1-month subscription and a 12-month subscription. Standard prices are US$4.99 per month and US$24.99 per year; prices in other countries vary by region, currency and local taxes. The exact price, subscription length and billing period that apply to you are always shown in the App before you confirm the purchase.

Billing and auto-renewal. Payment is charged to your Apple ID or Google account when you confirm the purchase. The subscription renews automatically for the same period unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.

Managing and cancelling. You can manage or cancel your subscription at any time in your Apple ID settings (Settings → your name → Subscriptions) or in Google Play (Payments & subscriptions → Subscriptions), and from the Account screen in the App. Cancelling stops the next renewal; you keep access until the end of the period you have already paid for. Deleting the App does not cancel a subscription.

Refunds and withdrawal. All payments are processed by Apple or Google, not by us — refund requests are handled under the Apple Media Services Terms and Conditions or the Google Play Terms of Service respectively. Unused portions of the current period are not refunded on cancellation, except where the law requires it. If you are a consumer in the EU, your statutory 14-day right of withdrawal for digital content applies as provided by law; this right may lapse once you expressly request immediate access to the paid features and acknowledge the loss of that right.

Price changes. We may change subscription prices. A change applies from the next billing period only, after you have been notified in advance and — where the platform requires it — have consented; otherwise the subscription will not renew at the new price.

Features may change. Features included in Evaxify Plus may be added, changed or removed as described in Section 9. Features announced as planned or "coming soon" are not part of what you pay for, and we do not guarantee their release.

14. App Store and Google Play

These Terms are concluded between you and us only, and not with Apple Inc. or Google LLC. The platform from which you obtained the App is not a party to these Terms.

• We — not Apple or Google — are solely responsible for the App, its content, maintenance, support and any warranty claims.
• Apple and Google have no obligation to provide maintenance or support services for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price of the App (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• We — not Apple or Google — are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet a legal or regulatory requirement, claims under consumer protection or similar legislation, and third-party claims that the App infringes intellectual property rights.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce these Terms against you as a third-party beneficiary.
